Sometimes this is called a Health Care
Power of Attorney or
Advanced Health Care Directive (AHCD). A durable power of attorney
for health care is normally several pages long and each person has to have his
or her own. This appoints someone, such as a spouse or a trusted relative,
to act for you as your health care financial manager if you are unable to do so for some
reason. This could be temporary or during a long illness, or it can have a broad scope of powers.
Q.
Who should have a Health Care Durable Power of Attorney or Advance Health Care
Directive (AHCD)? Everyone over the
age of 18. If you are married, your spouse has certain rights to act on your
behalf but they are limited. The Health Care Durable Power of Attorney gives your
agent rights that are spelled out in the Health Care Power of Attorney.
This includes important
medical decisions when you can't and make them as you want as directed in your
power of attorney. The best way to describe it, a Power of Attorney is a legal document
which gives the person you appoint to act as you would if you were able to do
so. Everyone over the age of 18 really needs one but it is sad that so many
elderly adults don't have one. Unfortunately, if they wait until something
happens, their wishes may not be carried out and the court might have to appoint
someone to carry out the health care duties.
Q. Who
should be named as my agent for my health care?
Most of the time the primary agent
is the spouse. But if the spouse is in bad health or is unable to act on
your behalf, you want to have at least another agent. This is also wise
because a car accident could disable both you and your spouse at the same time. It
is not uncommon to have two or three alternate agents or sometimes having two
agents working jointly.
Q.
Is a health care power of attorney revocable?
YES! you can revoke it
at any time and you can change who will act as your agent.
Also, the power of attorney for health has a limited effective span. I can
discuss this with you in detail when you retain my services or if you need my office to
draft the legal documents for you.
Q. Can I
limit the agent powers?
Yes, you can limit the powers or make it only
effective upon certain conditions. You might want to give your agent
the right pick up medication or to speak to your doctors on your behalf or to
have full authority over your health care needs. You can even specify in what
condition it shall become effective such as in an emergency or when you are
incapacitated, or it can be made
to be effective immediately. It is up to you when and how it becomes
effective. I will prepare the documents to represent
your wishes.
Q. Does
limited power of attorney cover my financial needs?
Financial issues and health care issues should be kept separate. Thus,
you should have two separate powers of attorneys. You might want one person
to cover your financial needs and another for the health issues. I would not
want a health care provider seeing everything I have or seeing what assets I
may or may not have. I only want my agent to show them my health care
directives, not the financial issues. Also, I would not want the bank to know my
health care requirements when it is not necessary.
Limiting certain powers.
I normally recommend that the agent does not have
complete power over life and death issues unless you have a condition that will only
worsen in the very near future unless the doctor indicates that there is no hope in recovery. This way the person knows what they are doing
is the right thing if it results in your life ending. A
durable power of attorney for health will help manage the health issues,
not to cause further ones.
